California Law - When Might Spousal Support Be Modified?

In general, spousal support may be modified upon:

  • A substantial change in circumstances, usually a substantial change in the income of one of the parties; or
  • Increased need of the recipient; or
  • The failure of the recipient spouse to make reasonable efforts to seek employment.

If the marriage was 10 years or longer, the court will normally keep the authority to modify spousal support.

Section 4336.

Cases:

Olson (1993) 17 Cal Rptr 2d 480 (decreased wages of husband, age 66, was a substantial change in income justifying a modification).

Weinstein (1991) 5 Cal Rptr 2d 558 (if payer-husband's income goes up after the dissolution, that is not a ground for modifying spousal support where existing support insured that wife maintained standard of living established during the marriage).
