California Law - What If A Spouse Wants To Move Away?

The court can decide whether a custodial parent may relocate.

Cases:

Burgess (1996) 913 P2d 473, 51 Cal Rptr 2d 444, 13 Cal 4th 25 (in a situation where the spouses had joint legal custody and the mother had sole physical custody, the court allowed the mother to move approximately 40 miles away from the husband, for her work. This was so even though the new job was not a promotion but a "lateral" move. It was enough that the mother took the job in good faith, not to frustrate the husband).
