California Law - If One Spouse Interferes With Visitation, May The Other Stop Making Payments? If a wife (for example) is ordered to have custody for some time, and the husband prevents her from getting custody, the wife may recover her costs in obtaining custody. However, the husband is not excused from making his support payments. Of course, the applies with the genders reversed as well. Section 3028.
