California Law - Are Any Debts Chargeable To the Other Spouse? In general, the separate property of one spouse is not liable for the debts of the other spouse, before or after the separation date. However, the separate property of a spouse is liable for debts incurred for the necessaries of life for the other spouse while the spouses are living together, or living separately before the divorce. The same is true for necessaries of life for children of the marriage. The payer spouse is entitled to be reimbursed from community property, if there is any. Note that earnings of a married person, if placed into separate accounts, are not liable for pre-marriage debts of the person's spouse. Sections 911, 913, 914, 2623, 2625.
