California Law - Does Fault Affect Spousal Support? No. Evidence of misconduct is generally not allowed to be presented to the judge. (This applies to the entire case, not just the spousal support portion.) There is one exception, which applies in relatively few cases: If one spouse is convicted of attempting to murder the other, then the murderous spouse is not permitted to receive spousal support from the intended victim. Section 2335, 4324.
