California Law - Inheritance An inheritance is the separate property of the spouse who receives it. An inheritance may remain separate property even if deposited in a joint bank account. The cash deposited must be clearly traceable to the inheritance. In this way, an inheritance is like any other separate property a spouse brings to a marriage. Cases: Braud (1996), 53 Cal Rptr 2d 179, 45 Cal App 4th 797 (discusses tracing of inheritance through bank account).
