California Law - Life Insurance On the Payer.

The court may order the payer also to purchase life insurance on the payer's life, with the recipient as beneficiary, to secure the payment of spousal support.

This ensures that the payer's responsibility to the recipient for spousal support can be met if the payer dies.

If term life insurance is purchased during the marriage, but renewed after the marriage, the community may have rights in the insurance proceeds.

Section 4360.

Bowman (1985) 217 Cal. Rptr. 174 (Husband had term life insurance through his job as a pilot. He and the company each paid a portion of the premium. He renewed the premium after the separation. Then he died. The court found that the community property interest is equal to the amount of life insurance benefits the husband would have been entitled to receive if he had terminated his employment at the date of separation. The percentage this amount constitutes compared to the actual benefits is community property.)
