California Law - What if a Spouse Lives Out of State? Only one spouse need reside in California to get a California divorce. On the other hand, if a spouse moves out of California to get an out-of-state divorce, California might not recognize it. California follows the Uniform Divorce Recognition Act . Section 2320.
