California Law - Can One Party Alone Bring About a Divorce? The court may order a divorce if the other party contests the divorce, if the court is convinced that there are irreconcilable differences which caused the marriage to break down in a way that can not be repaired. The court may also order a divorce even if only one party participates in the proceeding. But the court can do this only if the other party knows about the divorce proceeding, or if the one who files for the divorce has made reasonable attempts (which are detailed in the law) to let the other party know.
