California Law - What Factors Do Courts Consider in Property Division Because California is a community property state. The court aims for a 50/50 division of marital property, regardless of any other factors. There is some leeway for individual circumstances if there is a family home , or if some of the property consists of personal injury money . Also, the court can find some assets to be worth more than others, or to rule in disputed cases that funds have become community property (or remained separate). But in these cases, the court is supposedly following principles of law, not trying to "even things up". Otherwise, the court is bound to perform the precise 50/50 division of community property required by law.
