California Law - Must The Payer Keep The Spouse On His/Her Health Insurance? Under COBRA (the Consolidated Omnibus Budget Reconciliation Act of 1986), if your spouse's employer has 20 employees or more, your spouse's employer must allow you to have a policy with its health insurer for 3 years after the divorce. You must pay the premiums. There is no state statutory provision in California requiring a spouse to keep a former spouse on the health insurance policy. A former spouse may have conversion rights under the other spouse's group plan. However, the cost of health insurance is one of the factors the courts consider in figuring the amount of money necessary to maintain the marital standard of living.
