California Law - Can Separate Property Become Community Property Without a Gift? Separate cash that is contributed to a marital bank account is assumed to be community property through the doctrine of commingling. The separate property contribution must then be segregated through an acceptable tracing. Spouses must put in writing their intention to transform separate property to marital property. Section 852.
