California Law - Uniform Premarital Agreement Act

The Uniform Premarital Agreement Act says that premarital agreements are generally valid.

However, there are some exceptions.

First of all, an agreement to not seek child support is invalid and will not be upheld.

Also, the entire premarital agreement will be invalid if it is not executed voluntarily.

In addition, the agreement will not be enforced if it is very unfair, and all of the following are true:

  • The party did not disclose his (or her) finances; and
  • The other party did not sign anything saying she (or he) did not care about the other party's finances;
  • The other party did not already know about the other party's finances (or could easily have known).
