Florida Law - Does a Gift To A Spouse Become Separate Property? A gift to a spouse remains marital property. Example: Antony gives Cleopatra an expensive diamond necklace. In the divorce proceedings, the necklace is marital property, and Cleo's share of the other assets may be reduced by about half the value of the necklace.
