Florida Law - Do Courts Consider Fault In the Property Division?

Courts do not consider fault in dividing the property. It is purely an economic division based on considerations of economic fairness.

Cases:

Bell (1994) 642 So2d 1173 (child molestation not a factor).

Childers (1994) 640 So2d 108 (adultery not a factor in property division, unless it is related to the depletion of assets).

Murray (1994) 636 So2d 536 (misconduct not a factor).
