Florida Law - May Separate Property Be Divided?

Florida courts keep separate property separate.

So that if one spouse has a separate account, or owns the home separately, the courts will tend to let that spouse keep that property in the divorce, no matter how uneven is the resulting property division.

The court still has the option of using alimony, or so-called "lump-sum alimony" to even things out.

Section 61.075(1).

Cases:

Melvik (1996) 669 So2d 328 (furniture, furnishings, and engagement rings, were separate property of the respective spouses and thus could not be distributed).

Beaty v Gribble (1995) 652 So2d 1156 (in doing equal division, court allowed some of husband's separate property to given to wife in exchange for wife's share of the marital home; however, there may not have been enough such property to buy out wife's share).

Saare (1992) 610 So2d 628 (home was titled solely in husband's name, but appreciation in value, $20,000, was a marital asset that could be divided).
