Some clear situations regarding home purchase:

• Bought together: If the home is purchased entirely during the marriage with funds earned during the marriage (by either party), the home is entirely community property. Its value will generally be divided 50/50.
• Bought separately: If the home is purchased by one party before the marriage, and the entire mortgage is paid off before the marriage, the home is entirely separate property. The value of a separate home will generally stay with the owner.

But it's trickier if some of the funds were community property and some were separate property. In that case, the value is divided between the parties .
