Can I Use My Spouse's Lawyer

Sometimes, a spouse (often the husband) will say, "let's both use my lawyer, it will be cheaper."

A hopeful variant is, "let's both use my lawyer, so we'll get it over with more quickly and there will be less fighting."

A threatening variant on that is, "let's both use my lawyer, or you won't get anything."

An even more threatening variant is, "let's both use my lawyer, or I'll tell the judge about your affair, or your drinking, etc., and you won't get custody of the kids."

Don't believe any of it. You need someone in your corner.

If you want to resolve the matter cheaply and quickly, and you can both stand up for yourselves, you might want to consider mediation.

However, if you feel overwhelmed by your spouse's superior worldliness and financial knowledge, then you definitely need a lawyer.

If your spouse is being reasonable in his or her initial proposal, then your lawyer will see that and help you come to a quick resolution.

But if your spouse is threatening you, chances are his proposal was not all that reasonable. This happens all the time, and a competent lawyer will protect both you and the children.
