Why Lawyers View Children As Bargaining Chips

A few lawyers may view children as bargaining chips, to the detriment of the children.

In a typical situation, the husband actually does not want physical custody.

But often, the wife feels strongly that physical custody of the children is the most important thing to her.

A few lawyers representing husbands will suggest that the husband request custody, just to pressure the wife to compromise on the financial issues. These lawyers view the situation strictly as a maneuver in the legal chess game. In presenting the situation to their clients, these lawyers emphasize the financial and gamesmanship aspects.

One problem with this approach may be that, in order to sustain a request of custody, the husband must make the case claiming that the wife is unfit.

This results in the husband exaggerating the wife's failings in printed documents. This has the effect of upsetting the wife. It tends to adversely affect whatever ability the husband and wife had to work together to resolve the custody and financial issues.

The ones most hurt, of course, are the children. The children see the father saying these things about the mother. The children tend not to view this as a game. It can be emotionally hurtful to the children.

No matter what route you take to the negotiations, please try to avoid using the children as bargaining chips. It is almost guaranteed that using the children this way hurts everyone, ultimately including the bargaining parents, far more than they could ever hope to gain.
