Filing Motions Next comes the filing of motions. A motion is a request that the judge who is supervising the case order something to happen immediately, before the trial, and before the parties negotiate all the issues. (Remember that actual trials rarely happen.) Here are some motions commonly made:
Virtually anything a judge orders in a motion can be undone by a later agreement of the parties. However, sometimes these orders set like wet concrete -- and are as difficult to reshape.
