How is the Alimony Amount determined? Alimony varies widely from state to state. Some states, including New York, have the attitude that in "long term" marriages (typically, marriages of 10 years or more), where the wife was a full time homemaker and is raising the children, then the wife (typically) is entitled to alimony for the rest of her life. Other states, including Texas, have a policy attempting to limit alimony in all but the most extreme cases of earnings inability. In some cases, the goal of alimony is to maintain the marital standard of living. In others, the goal is simply to provide a cushion for a year or two, while the spouse becomes employable by going to school or getting job training. Click here for typical factors in granting alimony. There is an extensive state-by-state discussion of alimony in the "Law" tab of the program . Some legal strategists advise their clients to learn as much about their state's laws as possible, then get their spouse to agree to less alimony than the state would require.
