Can Child Alimony Payments Be Modified?
Alimony payments may be modified if there is a substantial change in circumstances.
This typically means:
-
Significant changes in the income of either party.
-
Co-habitation or remarriage of the recipient.
The agreement between the parties at the time of the divorce often lists reasons that
alimony will terminate. These reasons often explicitly include the death of the
payer or remarriage of the recipient. (Be careful to define "cohabitation" in a
clear, and easily-proved way.)
