Legal Custody

Legal custody refers to responsibility for making decisions about the child including:

  • Medical decisions;
  • Decisions about religion;
  • Decisions about education.

In order for this to work, the parents should either have similar values and priorities on these things, or should be able to compromise, remaining focused on what is best for the child.

As an alternative, the parents can divide up these three key areas (and others), with each parent taking sole responsibility for one area. This gets tricky too. For example, is the decision to send a child to a religious-oriented private school a religious decision or an education decision?

These decisions sometimes become great points of contention after the divorce, especially if they were points of contention during the marriage. It is generally recommended that each party recognize that he or she will not get everything he or she wants, even on deeply-felt issues. Try to look at each child and do what is really best for that child.
