Massachusetts Law - Separate Property in General

In most states, "separate property" is property that is any of the following:

  • Property a party owned before marriage.
  • Property a party acquired during the marriage by gift or inheritance .
  • Income from either of these.
  • Property acquired explicitly as separate property during the marriage.
  • Post-separation earnings, gains, or winnings.

In most states, separate property always remains with the party who owns it, and only so-called "marital" property is divided.

However, Massachusetts does not make this kind of distinction between separate and marital property.
