Physical Custody

Physical custody refers to the child's residence and day-to-day care.

Physical custody may be "sole" or "joint." There are a number of other phrases, like "shared custody," but these are all variations on the same theme.

In practice, most children today are in sole custody of the mother. The children often visit the father on weekends and for an evening meal during the week. If the parents live far apart, it is not uncommon for children, especially older children, to spend the school year with the mother and the summer with the father.

However, a wide variety of situations have developed. A few children alternate days at each home. A few others spend half the week at each home. Others spend two weeks with Mom and two weeks with Dad. In at least one case, the kids stayed put and the parents rotated living in the family home.

Despite the custody agreement, teenagers often develop a strong desire to live with their father, whom they often barely know. The parties often accede to this desire. The teenager often returns to the mother after a year is up, often disillusioned.
