Illinois Law - May the Court Award Attorneys' Fees.

The court may award attorney's fees. That is, the court may order one party to pay some or all of the other party's attorney's fees.

In awarding attorneys' fees, the court considers the following factors:

  • The income and property of each party.
  • The needs of each party.
  • The realistic earning capacity of each party.
  • Any obstacle to present earning ability of either party such as age, physical or emotional health.
  • The standard of living established during the marriage.
  • The degree of complexity of the issues: custody, valuation or division of closely held businesses, tax planning, reasonable needs for expert investigations or witnesses.
  • Each party's access to relevant information.
  • The amount of payments made or reasonable to make for an attorney.
  • Any other factor found to be right and fair.
