Illinois Law - What Are The Child Support Guidelines? Under federal law each state has established a mathematical formula for calculating child support. (Click here to read why and here for an overview of these formulas.) The courts tend to follow these formulas pretty closely. (Click here for more on this.) This section gives a brief overview of the child support guidelines in Illinois. In Illinois, the child support obligation is a flat percent of the non-custodial parent's net income. Click here for a chart showing the percents, by number of children. Net income is basically calculated as gross income minus state and federal taxes, FICA, mandatory retirement plan contributions, union dues, dependent and individual health insurance, support for prior families, certain debt payments, medical expenditures necessary for life or health, and other expenditures for the benefit of the child and the non-custodial parent (but not gifts).
