Illinois Law - Does the Court Listen to the Children? The advantage of a court listening to a child's preference is that the child may be better off staying with the parent he or she prefers. Also, the child may have a valuable perspective to add. The disadvantage is that it could lead the parents to start coaching or bribing the child, or bad-mouthing the other parent, and that this would harm the child. In Illinois, the law instructs the court to consider the child's wishes. The court may interview the child regarding the child's wishes as to his custodian and as to visitation. Lawyers are generally present at this interview. Also, a court reporter makes a transcript of the session. Sections 5/602(a)(1), 5/604.
