Illinois Law - Joint Custody Joint custody means custody pursuant to a Joint Parenting Agreement or Joint Parenting Order. This is an agreement or court order that specifies each parent's powers, rights and responsibilities for the personal care of the child. It also describes who will be responsible for major decisions such as:
The agreement or order also specifies a procedure by which proposed changes, disputes and alleged violations may be resolved. Also, the parents are required to review the agreement on a regular basis. Joint custody does not necessarily mean equal parenting time. Section 5/602(c), 5/602.1(d), 5/610(d).
