Illinois Law - Can the Court Order Marriage Counseling? The court may, at the request of one or more party, or on its own, order marriage counseling. The court may also order the parties not to attend marriage counseling, if it thinks counseling would hurt the parties. If there are minor children, the court may also order the parents to attend sessions to educate the parents on the impact of divorce on children. Sections 5/404, 5/404.1
