Illinois Law - The Home The court must by law consider whether it is desirable to continue the custodial spouse living in the family home, and to make a property division, and/or spousal maintenance award, that accomplishes this. For example, the court might order that the wife and children stay in the home until the youngest child reaches age 18, and that the home then be sold and the proceeds divided 50/50. Section 5/503(d).
