Indiana Law - May the Court Award Attorneys' Fees.

The court may award attorney's fees. That is, the court may order one party to pay some or all of the other party's attorney's fees.

The court will consider factors including the following:

  • The amount of assets awarded to the parties.
  • The relative earning ability of the parties.
  • Whether one party has easier access to cash for expenses than the other party.
  • Which party initiated the action.

Section 31-1-11.5-16(a).
