Indiana Law - At What Date Do We Value the Business? The business will generally be valued at the date the petition is filed, unless there is a good reason for using another date. Especially if, for example, the operator of the business has trashed it since the divorce was filed, the court might use the date the petition was filed to value the business. Or, if the business has soared since the divorce was filed thanks to the efforts of one spouse, the court might reward the hard-working spouse by using the date of the filing of the petition, with its lower value, as the date the business is valued. Cases: Sloss (1988) 526 NE2d 1036 (over course of five year marriage, husband spent $600,000, all of wife's inheritance, the last $100,000 between filing for divorce and final hearing; court used date of filing and ordered husband to repay $100,000 to wife).
