Indiana Law - What is "Marital Property?"
In most states, the courts draw a sharp distinction between "marital" property and "separate"
property.
At the divorce, courts in other states divide "marital" property between the parties and leave
the "separate" property in the hands of whoever owns it.
Not so in Indiana.
Indiana has a "one pot" theory, which means that all property owned by either party at the time of
the divorce is fair game to be divided.
