Indiana Law - What is the "Marital Portion" of a Defined Benefit Pension Plan?
The marital portion of a pension plan in most state is: the number of years married and employed,
divided by the total number of years working until retirement.
However, under the "one pot" theory, such fine distinctions are less important in Indiana. The
judge will simply award each party as much or little of the pension plan as he or she thinks
is fair.
