Indiana Law - Post-Separation Earnings

Earnings of a party after the divorce is filed are not subject to division in the divorce proceedings.

However, a court may consider each spouse's earnings and earning capacity in the property division.

Section 31-1-11.5-11(c).

Cases:

Bressler (1992) 601 NE2d 392 (post-separation earnings are not divisible, but may influence the property division).
