Indiana Law - Can One Party Alone Bring About a Divorce?

One party may commence a divorce proceeding without the other party's consent.

As long as the other party is formally notified about the proceeding, the court may grant a divorce even if the other party does not respond.

The court may also grant a divorce even if the other party does not want one, as long as the court is convinced that the marriage is irretrievably broken.

Rose (1988) 526 NE2d 231 (other party need not appear in order for court to grant divorce).
