Indiana Law - What Factors Do Courts Consider in Property Division
The court will consider the following factors in its property division:

The contribution of each spouse to the acquisition of property (including as a homemaker spouse).

The extent to which property was acquired before marriage or by gift or inheritance.

The economic circumstances of each party.

The desirability of awarding the home (or the right to live there) to the spouse who has custody of any children.

Any reckless or wasteful spending of cash or other assets during the marriage.

Earnings or earning ability of the parties.
The court may order one spouse to pay even more than that spouse's assets, if the money is to contribute
toward tuition, books, and lab fees for higher education of another spouse.
