Massachusetts Law - How Do We Divide Part-Marital / Part-Separate Property? In many states, the courts attempt to carefully trace the pre-marital contribution to a home, for example, in determining how much of that home each party will keep. These states specify mathematical formulas for determining each party's "separate" ownership portion. One typical approach is to give a party a separate share in the current value equal to that party's separate contribution to the purchase price, and then divide the remainder of the equity equally between both parties. In Massachusetts this is not the case. The judge considers these issues, but only in a general sense, not by following a mathematical formula.
