Massachusetts Law - What is 'Marital Property?' In general, all property acquired during the marriage is marital property. Examples: Marital property generally includes the following:
Section 34. In Massachusetts, the judge may divide both "marital" and "separate" property, so the distinction between them is unimportant in this state. Cases: Dalessio (1991) 570 NE2d 139 (judge has broad discretion to divide assets fairly.)
