Massachusetts Law - Can the Court Order Arbitration? Massachusetts law does not contain any provision permitting the court to order arbitration rather than a trial. Every divorce case in Massachusetts is thus heard (or at least the parties' agreement is reviewed) by a judge, not an arbitrator. Cases: Gustin (1995) 652 NE2d 610 (The lower court had ordered the couple to submit to binding arbitration on the issue of division of household property. The appeals court overturned that ruling, saying that the court could not compel a couple to arbitration. However, the court could have required them to present their case to an arbitrator, who could make a recommendation to a judge.)
