Massachusetts Law - How Long Must You Live In the State? If the person filing for the divorce came to Massachusetts after the marriage had ended, then he or she has to be a resident of Massachusetts for one year before filing for the divorce. However, if the couple lived together while married in Massachusetts, and the ground is irretrievable breakdown ("no-fault"), then there is no additional residency period required before filing for divorce.
