Massachusetts Law - Can One Party Alone Bring About a Divorce? One party may obtain a divorce without the other party's consent, if the judge concludes that there is no chance the marriage will be patched up. Also, one party may obtain a divorce even if the other party does not respond to the filing. If the other party does not respond to the filing, the one who files must make reasonable efforts to locate that party and let him or her know about the filing. If the other party is not responding to the filing, then the law requires a six-month waiting period before a divorce will be granted. Section 1B.
