Michigan Law - When Might Alimony Be Modified? Alimony may be modified upon a change in circumstances, such as an increase or decrease in either party's income. In Michigan, the death of the paying party does not release that party from the obligation of alimony. What this means is that if there are any assets at death, those assets must be used to continue to pay the alimony. Alimony will often be set to terminate upon remarriage of the party who is receiving the payments, although the parties may agree otherwise. Cases: Brafett, 308 Mich 506 (death of husband does not end decree for alimony).
