Michigan Law - If One Spouse Interferes With Visitation, May The Other Stop Making Payments?

If one spouse prevents another from visitation, the thwarted spouse still must pay alimony and child support.

If a spouse refuses to pay child support, then the judge may terminate that spouse's visitation rights.

Section 25.164(42).

Cases:

Robinson v. Harris, 87 Mich App 69 (The court determined that the husband's obligation to pay child support was independent of his right to visit the children. The court found that in the years following the divorce, the children had become embittered toward their father, to the extent that any meaningful relationship between the husband and the children was impossible. The husband felt that he was therefore no longer obligated to pay child support payments to the wife. However, since the wife was receiving aid from the state for the support of the children, there was no possibility of "punishing" the wife for embittering the children or to encourage her to uphold the visitation agreement. The husband was obligated to reimburse the state.)
