Michigan Law - Personal Injury Money received on account of personal injuries is a marital asset, subject to division upon divorce in Michigan. Cases: Bywater (1983) 128 Mich App 396 (The court concluded that personal injury awards for pain and suffering are marital property. Thus, they must be shared with the other spouse in a divorce. This is the case even though pain and suffering are "personal" to the injured spouse. In this case, the injury occurred before the divorce. Also, a lot of the negotiations with the insurance company occurred before the divorce as well. The injured spouse had agreed to the settlement one month after the divorce filing. The settlement amount was $52,000.)
