Michigan Law - Is This A "No-Fault" Divorce State? Michigan is a no-fault divorce state. This means that the party who wants a divorce does not have to show a specific misbehavior on the part of the other spouse, such as adultery, abandonment, drunkenness or addiction, abuse, etc. The party simply has to state that there is no chance the marriage will be patched up, and that is sufficient grounds for a divorce. Section 25.86. Cases: Mumaw, 124 Mich App 114 (In this case, the court ruled that fault does not affect the validity of a judgment for divorce. The husband had complained that both parties were not equally at fault for the breakdown of the marriage. However, the court said that this was insignificant. The court shall grant a divorce if the "objects of matrimony" have been destroyed and it is unlikely that the marriage can be saved.)
