Michigan Law - Is There a Minimum Waiting Period After Filing? There is a 60 day waiting period between filing and the time the trial court may hear the case. This period is extended to six months in a case where there is a child under age 18 involved. The court may make an exception in the event of a compelling necessity, but only to hear the case, not to grant the divorce. Section 25.89.
