New York Law - Will the Court Award Temporary Spousal Maintenance Before Divorce? The court may award spousal maintenance during the divorce proceedings. Section 236.B.6. Cases: Ferdinand (1995) 625 NYS2d 650 (The court found that certain of the wife's monthly expenses were excessive or unnecessary. (The record does not say which expenses.) So the court reduced the alimony during proceedings from the original order of $600 per week to $475 per week.)
