New York Law - Must The Payer Keep The Children On His/Her Health Insurance? The court may order either spouse to provide health insurance for the children. If either parent has health insurance available, then the court will order that parent to put the child on his or her health insurance policy. The court may divide the cost of this insurance between the parties. Section 236.B.8, 240.1.
